1. Acceptance of Terms

By creating an account, downloading, installing, or using the CasperVPN application or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.

2. Description of Service

CasperVPN provides a virtual private network (VPN) service that encrypts your internet connection and routes it through our servers. The Service includes VPN client applications for iOS, Android, Windows, macOS, and Linux; access to VPN servers in multiple geographic locations; support for WireGuard, IKEv2, and OpenVPN protocols; and related features as described on our website and app stores. The Service is designed to enhance your online privacy and security. It is not designed to enable, facilitate, or encourage illegal activity.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password, or register using Apple Sign-In or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to use a strong, unique password, not share your credentials, and notify us immediately at support@caspervpn.com if you suspect unauthorized use.

4. Subscription Plans and Payment

CasperVPN offers free and paid subscription plans. Details of current plans, pricing, and features are available at caspervpn.com/pricing. Paid subscriptions are billed in advance on a recurring basis through our payment processors, Apple App Store, or Google Play Store.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings, the Apple App Store, or Google Play Store. Cancellation takes effect at the end of the current billing period.

Refunds: We offer a 30-day money-back guarantee for first-time subscribers on web purchases. Refund requests must be submitted to support@caspervpn.com within 30 days of the initial purchase. Apple App Store and Google Play purchases are governed by their respective refund policies. We may change subscription prices with at least 30 days' notice.

5. Acceptable Use Policy

You may use the Service for lawful purposes including protecting your privacy and security, accessing regionally available content, and encrypting your connection on untrusted networks.

You agree not to use the Service to violate any law, transmit harmful or objectionable material, distribute malware, send spam or conduct phishing, engage in network attacks (DoS/DDoS, port scanning, unauthorized access), infringe intellectual property, distribute CSAM, interfere with the Service, circumvent technical restrictions, or resell your account access. We reserve the right to suspend or terminate accounts that violate this policy.

6. Intellectual Property

The Service, including all software, design, branding, trademarks, and content, is owned by CasperVPN or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use. You may not reverse engineer, decompile, copy, modify, or create derivative works of the Service.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While CasperVPN enhances your online privacy, we do not guarantee absolute anonymity. We strive for high availability but do not guarantee uninterrupted, error-free, or secure access. VPN usage inherently affects internet speed — we do not guarantee specific speed or performance levels.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CasperVPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

For EU Consumers: Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable EU law.

9. Indemnification

You agree to indemnify and hold harmless CasperVPN from any claims, liabilities, damages, losses, and expenses arising out of your use or misuse of the Service, your violation of these Terms, or your violation of any law or third-party rights.

10. Termination

You may terminate your account at any time by contacting support@caspervpn.com or through your account settings. We may suspend or terminate your account immediately if you violate these Terms, pose a security risk, fail to pay fees, or we are required to by law. Upon termination, your license to use the Service is revoked and your data will be deleted per our Privacy Policy retention schedule.

11. Dispute Resolution

Before initiating formal proceedings, you agree to contact us at legal@caspervpn.com and attempt to resolve the dispute informally for at least 30 days.

EU Residents: Disputes shall be submitted to the competent courts of your country of residence. California Residents: Disputes shall be submitted to binding arbitration under AAA rules. Lebanese Residents: Disputes shall be submitted to the competent courts of Beirut, Lebanon. To the extent permitted by law, dispute resolution will be conducted on an individual basis only.

12. General Provisions

These Terms, together with the Privacy Policy and other policies referenced herein, constitute the entire agreement. If any provision is held invalid, the remainder continues in full force. Our failure to enforce any right does not constitute a waiver. We are not liable for failures due to force majeure events.

13. Changes to These Terms

We may modify these Terms at any time. Material changes take effect 30 days after notice via our website, email, and in-app notification. Your continued use after the effective date constitutes acceptance.

14. Open Source Acknowledgments

CasperVPN uses open-source software components, each governed by its own license. Key components include WireGuardKit (MIT License). Additional open-source licenses are listed within the application under Settings > Licenses.
